Additionally, if an individual uses an AI system to further commit or attempt another crime, they will also face the same felony charge and consecutive sentencing. For those who design, distribute, or warehouse AI systems intended for criminal use, the penalty is a four-year felony, also subject to consecutive sentencing.

The bill further clarifies that sentences imposed under this section cannot be suspended, and individuals are ineligible for parole or probation during their mandatory terms. It also mandates restitution for victims in accordance with existing laws. Importantly, the bill includes a provision exempting law enforcement officers from these penalties when utilizing AI systems in the course of their official duties. Definitions for "AI system" and "person" are provided to clarify the scope of the law, ensuring that it targets specific actions and entities involved in the misuse of AI technology. The bill is set to take effect 90 days after being enacted into law.
