The proposed bill amends the Michigan Penal Code by adding Section 411y, which establishes penalties for individuals involved in the possession, development, deployment, or modification of artificial intelligence (AI) systems with the intent to commit a crime. Specifically, it stipulates that a person found guilty of these actions will face a felony charge and a mandatory imprisonment term of eight years, which must run consecutively to any other sentences related to the same transaction. Additionally, if an AI system is used in furtherance of committing or attempting to commit another crime, the individual will also face an eight-year felony charge, with the sentence served consecutively to any other related convictions.
Furthermore, the bill outlines penalties for those who design, distribute, or warehouse AI systems intended for criminal use, imposing a four-year felony charge for such actions. The bill mandates that all terms of imprisonment under this section cannot be suspended, and individuals are ineligible for parole or probation during their sentences. It also clarifies that law enforcement officers authorized to use AI systems in their official duties are exempt from these provisions. The bill defines "AI system" and "person" for clarity, ensuring that the legislation is comprehensive in addressing the use of AI in criminal activities. The act will take effect 90 days after being enacted into law.
