The proposed bill amends the Michigan penal code by adding Section 411y, which establishes penalties for individuals involved in the possession, development, deployment, or modification of artificial intelligence (AI) systems with the intent to commit a crime. Specifically, it stipulates that a person found guilty of such actions will face a felony charge and a mandatory imprisonment term of eight years, which must run consecutively to any other sentences arising from the same transaction. Additionally, if an individual uses an AI system to further commit or attempt another crime, they will also face the same felony charge and consecutive sentencing. The bill further outlines penalties for those who design or distribute AI systems intended for criminal use, imposing a four-year felony charge with similar consecutive sentencing requirements.

The bill includes provisions that prohibit the suspension of sentences and make individuals ineligible for parole or probation during their mandatory terms. It also mandates restitution for victims in accordance with existing laws. Notably, the legislation exempts law enforcement officers authorized to use AI systems in the performance of their official duties. The bill defines "AI system" broadly, encompassing various machine-based systems capable of processing data and simulating human-like interactions, while excluding certain AI-adjacent technologies. The enactment of this bill will take effect 90 days after it is signed into law.
