This bill amends the Michigan Code of Criminal Procedure by updating Section 13m of Chapter XVII, which pertains to the classification of certain felonies related to controlled substances. The bill introduces new legal language that specifies the application of this chapter to various felonies enumerated in Chapter 333 of the Michigan Compiled Laws, including the sale, distribution, or delivery of products containing ephedrine or pseudoephedrine, as well as the solicitation of these substances for the manufacture of methamphetamine. Additionally, it outlines the classifications and maximum penalties for various offenses involving controlled substances, including heroin, fentanyl, and marijuana.
The bill also makes several deletions from the existing law, particularly in the classifications of certain controlled substance offenses, which are being updated to reflect current legal standards. For instance, it removes specific classifications related to the delivery or manufacture of large quantities of certain schedule 1 or 2 controlled substances, while adding new classifications for offenses involving methamphetamine and other controlled substances. The enactment of this bill is contingent upon the passage of Senate Bill No. 430 and will take effect 90 days after being enacted into law.
