This bill amends the 1973 PA 116, which regulates child care organizations in Michigan, by establishing ad hoc committees for each type of child care organization. These committees will assist in formulating and amending rules, ensuring that a majority of members are representatives from affected organizations and parents. The bill mandates that rules cover essential aspects of child care operations, such as staff qualifications, safety standards, and children's rights, and requires a review of these rules every five years. Child care organizations will have 90 days to comply with new rules unless there is an immediate federal obligation or health risk.
Additionally, the bill enhances the background check process for individuals involved in child care organizations, requiring comprehensive checks that include criminal registries and the national sex offender registry, along with fingerprinting. It allows individuals to serve as staff under supervision while awaiting check results and introduces a mechanism for those with criminal histories to request a redetermination if their records have been expunged. The bill also addresses the confidentiality of records related to children in child care, specifying who may access these records and introducing disciplinary actions for non-compliance. Furthermore, it permits child care centers to operate temporarily at unlicensed locations during disasters with prior approval and waives certain inspections if the new location is in a certified safe school building. Lastly, it exempts audio or video recordings submitted by licensees from disclosure under the Freedom of Information Act.
