A bill to amend 2000 PA 274, entitled
"Large carnivore act,"
by amending section 2 (MCL 287.1102), as amended by 2018 PA 610.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2. As used in this act:
2 (a) "Animal control officer" means a county animal control
3 officer as described in sections 29a and 29b of the dog law of
4 1919, 1919 PA 339, MCL 287.289a and 287.289b, or a city, village,
5 or township animal control officer as described in section 29c of
6 the dog law of 1919, 1919 PA 339, MCL 287.289c.

1 (b) "Animal control shelter" or and "animal protection
2 shelter" means an animal control shelter or animal protection
3 shelter, respectively, registered mean those terms as defined in
4 section 1 of 1969 PA 287, MCL 287.381, and are facilities licensed
5 with the department under section 6 4 of 1969 PA 287, MCL
6 287.336.287.334.
7 (c) "Breeding license" means the license granted under section
8 22b.
9 (d) "Department" means the department of agriculture and rural
10 development.
11 (e) "Facility" means an indoor or outdoor cage, pen, or
12 similar enclosure where a large carnivore is kept.
13 (f) "Large carnivore" means either of the following:
14 (i) Any of the following cats of the Felidae family, whether
15 wild or captive bred, including a hybrid cross with such a cat:
16 (A) A lion.
17 (B) A leopard, including, but not limited to, a snow leopard
18 or clouded leopard.
19 (C) A jaguar.
20 (D) A tiger.
21 (E) A cougar.
22 (F) A panther.
23 (G) A cheetah.
24 (ii) A bear of a species that is native or nonnative to this
25 state, whether wild or captive bred.
26 (g) "Law enforcement officer" means:
27 (i) A sheriff or sheriff's deputy.
28 (ii) A village or township marshal.
29 (iii) An officer of the police department of a city, village, or

1 township.
2 (iv) An officer of the Michigan state police.
3 (v) A peace officer who is trained and licensed or certified
4 under the Michigan commission on law enforcement standards act,
5 1965 PA 203, MCL 28.601 to 28.615.
6 (vi) A conservation officer appointed by the department of
7 natural resources.
8 (vii) An animal control officer.
9 (viii) A law enforcement officer of the federal government
10 authorized to enforce any federal law regulating animals.
11 (h) "Livestock" means those species of animals used for human
12 food and for fiber or those species of animals used for service to
13 humans. Livestock includes, but is not limited to, cattle, sheep,
14 new world camelids, old world camelids, goats, bison, privately
15 owned cervids, ratites, swine, equine, poultry, aquaculture
16 species, and rabbits. Livestock does not include dogs or cats.
17 (i) "Local unit" means a city, village, township, or county.
18 (j) "Permit" means a permit issued under section 4.
19 (k) "Permitting agency" means the agency of a local unit that
20 issues permits under section 4.
21 (l) "Person" means an individual, partnership, corporation,
22 association, governmental entity, or other legal entity.
23 (m) "Pet shop" means a pet shop licensed by the department
24 under section 3 4 of 1969 PA 287, MCL 287.333.287.334.
25 (n) "State veterinarian" means the chief animal health
26 official of this state as appointed by the director of the
27 department under section 7 of the animal industry act, 1988 PA 466,
28 287.707, or his or her the director's authorized representative.
29 (o) "Veterinarian" means a person licensed to engage in the

1 practice of veterinary medicine under article 15 part 188 of the
2 public health code, 1978 PA 368, MCL 333.16101 333.18801 to
3 333.18838.
4 Enacting section 1. This amendatory act does not take effect
5 unless Senate Bill No.____ or House Bill No.____ (request no.
6 06071'24) of the 102nd Legislature is enacted into law.
