A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
by amending section 317a (MCL 750.317a), as added by 2005 PA 167.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 317a. A person who delivers a schedule 1 or 2 controlled
2 substance , other than marihuana, to another person in violation of
3 section 7401 of the public health code, 1978 PA 368, MCL 333.7401,
4 that is consumed by that person or any other person and that causes
5 the death of that person or other person is guilty of a felony
6 punishable by imprisonment for life or any term of years.

1 Enacting section 1. This amendatory act takes effect 90 days
2 after the date it is enacted into law.
3 Enacting section 2. This amendatory act does not take effect
4 unless Senate Bill No.____ or House Bill No. 6241 (request no.
5 04241'23) of the 102nd Legislature is enacted into law.
