A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 2220.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2220. (1) The palliative care advisory task force is
2 created in the department.
3 (2) Not later than January 1, 2026, the governor, with the
4 advice and consent of the senate, shall appoint the members of the
5 palliative care advisory task force. The palliative care advisory
6 task force must consist of the following 13 members:

1 (a) An individual representing a statewide organization
2 representing hospices and home care agencies.
3 (b) Five individuals who are palliative care clinical experts,
4 including, but not limited to, physicians, registered nurses, and
5 nurse practitioners.
6 (c) Two individuals who represent leaders or administrators in
7 the provision of palliative care.
8 (d) Two individuals who represent a patient receiving
9 palliative care or family members of a patient receiving palliative
10 care.
11 (e) An individual who represents a statewide organization that
12 represents insurance companies.
13 (f) An individual who represents Blue Cross Blue Shield
14 Association.
15 (g) An individual who represents the Children's Palliative
16 Care Coalition of Michigan.
17 (3) The term of a member of the palliative care advisory task
18 force is 4 years. If a vacancy occurs on the palliative care
19 advisory task force, the governor, with the advice and consent of
20 the senate, shall appoint an individual to fill the vacancy for the
21 balance of the term.
22 (4) The governor may remove a member of the palliative care
23 advisory task force for incompetence, dereliction of duty,
24 malfeasance, misfeasance, or nonfeasance in office, or any other
25 good cause.
26 (5) A member shall call the first meeting of the palliative
27 care advisory task force. At the first meeting, the palliative care
28 advisory task force shall elect a member as a chairperson and may
29 elect other officers that it considers necessary or appropriate.

1 The palliative care advisory task force shall meet at least
2 quarterly, or more frequently at the call of the chairperson or at
3 the request of 3 or more members.
4 (6) A majority of the members of the palliative care advisory
5 task force constitutes a quorum for transacting business. A quorum
6 of the members of the palliative care advisory task force serving
7 is required for any action of the palliative care advisory task
8 force.
9 (7) The palliative care advisory task force shall conduct its
10 business in compliance with the open meetings act, 1976 PA 267, MCL
11 15.261 to 15.275.
12 (8) A writing that is prepared, owned, used, possessed, or
13 retained by the palliative care advisory task force in performing
14 an official function is subject to the freedom of information act,
15 1976 PA 442, MCL 15.231 to 15.246.
16 (9) A member of the palliative care advisory task force is not
17 entitled to compensation for service on the palliative care
18 advisory task force but the department may reimburse a member for
19 actual and necessary expenses incurred in serving.
20 (10) The palliative care advisory task force shall do all of
21 the following:
22 (a) Provide the legislature with a recommended definition for
23 palliative care within this state.
24 (b) Conduct research on palliative care.
25 (c) Make recommendations that will expand the provision of
26 palliative care.
27 (d) Identify palliative care services that are offered and
28 measures for reimbursement of the services.
29 (e) Develop key program metrics for palliative care services

1 and make recommendations to the department and the legislature.
2 (f) Collaborate with individuals who are able to improve and
3 expand high-quality palliative care services.
4 (g) Develop engagement strategies to educate the public on
5 access to palliative care and to improve an individual's ability to
6 make informed decisions on preferred care.
7 (h) Identify the capacity of palliative care providers to
8 provide palliative care services.
9 (11) Not later than January 1, 2027, and every year
10 thereafter, the palliative care task force shall create and make
11 publicly available a report that identifies the palliative care
12 services available in this state and any palliative care services
13 that are not offered in this state but would provide a benefit.
