A bill to amend 1949 PA 300, entitled
"Michigan vehicle code,"
by amending section 806 (MCL 257.806), as amended by 2023 PA 129.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 806. (1) Until October 1, 2027, an applicant for a
2 certificate of title required by this act or an applicant for a
3 duplicate of a certificate of title shall accompany the application
4 with a fee of $10.00. An applicant that requests that the
5 application be given special expeditious treatment shall accompany

1 the application with an additional fee of $5.00. The secretary of
2 state shall collect a $3.00 service fee, in addition to the other
3 fees collected under this subsection, for each title issued and
4 shall deposit the fee in the transportation administration
5 collection fund created under section 810b through October 1, 2027.
6 Until October 1, 2027, the $5.00 expeditious treatment fee must be
7 deposited into the transportation administration collection fund
8 created under section 810b.
9 (2) An applicant for a special identifying number under
10 section 230 shall accompany the application with a fee of $10.00.
11 (3) In addition to paying the fees required by subsection (1),
12 until December 31, 2027, each person that applies for a certificate
13 of title, a salvage vehicle certificate of title, or a scrap
14 certificate of title under this act shall pay a tire disposal
15 surcharge of $1.50 for each certificate of title or duplicate of a
16 certificate of title that person receives. The secretary of state
17 shall deposit money received under this subsection into the scrap
18 tire regulatory fund created in section 16908 of the natural
19 resources and environmental protection act, 1994 PA 451, MCL
20 324.16908.
21 (4) Beginning January 1, 2026 and subject to modification
22 under this subsection, for each transfer of title by a dealer under
23 this act, the dealer shall submit a $5.00 fee to the secretary of
24 state. The secretary of state shall deposit the fee into the motor
25 vehicle sales finance act fund created under subsection (5). No
26 later than July 1, 2028 and July 1 every 2 years thereafter, the
27 director of the department of insurance and financial services
28 shall adjust the fee under this subsection, rounded to the nearest
29 whole dollar amount not to exceed $5.00, to the amount necessary to

1 pay, but not exceed, the department's reasonably anticipated costs
2 for administering the motor vehicle sales finance act, 1950 (Ex
3 Sess) PA 27, MCL 492.101 to 492.141. The director of the department
4 of insurance and financial services shall notify the secretary of
5 state of the adjusted fee. The adjusted fee takes effect January 1
6 following the adjustment. The director of the department of
7 insurance and financial services shall communicate the adjusted fee
8 to the dealers by bulletin at the time the department sets the
9 documentary preparation fee under section 113 of the motor vehicle
10 sales finance act, 1950 (Ex Sess) PA 27, MCL 492.113.
11 (5) The motor vehicle sales finance act fund is created in the
12 state treasury.
13 (6) The state treasurer shall deposit money and other assets
14 received from the fees collected under subsection (4) and the motor
15 vehicle sales finance act, 1950 (Ex Sess) PA 27, MCL 492.101 to
16 492.141, or from any other source in the fund. The state treasurer
17 shall direct the investment of money in the fund and credit
18 interest and earnings from the investments to the fund. Money in
19 the fund at the close of the fiscal year remains in the fund and
20 does not lapse to the general fund.
21 (7) The department of insurance and financial services is the
22 administrator of the fund for audits of the fund.
23 (8) The department of insurance and financial services shall
24 expend money from the fund on appropriation for the administration
25 of the motor vehicle sales finance act, 1950 (Ex Sess) PA 27, MCL
26 492.101 to 492.141.
27 Enacting section 1. This amendatory act does not take effect
28 unless House Bill No. 5354 of the 102nd Legislature is enacted into
29 law.
