A bill to amend 1988 PA 466, entitled
"Animal industry act,"
(MCL 287.701 to 287.746) by amending the title, as amended by 2019
PA 132, and by adding section 40c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 TITLE
2 An act to authorize and require the appointment of a state
3 veterinarian within the department of agriculture and rural
4 development; to protect the human food chain and the livestock
5 industry of this state through prevention, control, and eradication
6 of infectious or toxicological diseases of livestock and other

1 animals; to prevent the importation of certain nonindigenous
2 animals under certain circumstances; to safeguard the human
3 population from certain diseases that are communicable between
4 animals and humans; to prevent or control the contamination of
5 animals with certain toxic substances through certain animals or
6 animal products; to provide certain standards of care and housing
7 for certain animals; to provide for indemnification for livestock
8 under certain circumstances; to provide for certain powers and
9 duties for certain state agencies and departments; to provide for
10 the promulgation of rules; to provide for certain hearings; to
11 provide for remedies and penalties; and to repeal acts and parts of
12 acts.
13 Sec. 40c. (1) A person shall not engage in the force-feeding
14 of a bird.
15 (2) A person that violates subsection (1) is subject to a
16 civil fine of not more than $1,000.00. Each day that the violation
17 continues, the person is responsible for an additional civil fine
18 of not more than $1,000.00 per day. The prosecutor of the county in
19 which the violation occurred or the attorney general may bring an
20 action to collect the fine. The criminal penalties provided in
21 section 44 are not applicable to a violation of subsection (1).
22 (3) As used in this section:
23 (a) "Bird" means any species of poultry.
24 (b) "Force-feeding" means to deliver food by placing a tube or
25 other device into the esophagus of a bird and includes any other
26 feeding method designed to cause ingestion of an amount of food by
27 a bird that exceeds the amount that would be ingested voluntarily.
