A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 22224c.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 22224c. (1) A person that is seeking to initiate, expand,
2 replace, relocate, or acquire 1 or more of the following services
3 for the purpose of providing the services through an outpatient
4 imaging center may file a letter of intent with the department
5 before beginning the initiation, expansion, replacement,
6 relocation, or acquisition of the service, instead of obtaining a

1 certificate of need:
2 (a) A positron emission tomography scanner service.
3 (b) A fixed or mobile magnetic resonance imager service.
4 (c) A fixed or mobile computerized tomography scanner service.
5 (2) Not more than 30 days after receiving the letter of intent
6 under subsection (1), if the department verifies the services will
7 be provided through an outpatient imaging center, the department
8 shall send a written acknowledgment to the person approving the
9 initiation, expansion, replacement, relocation, or acquisition of,
10 for purposes of providing an outpatient imaging center, 1 or more
11 of the services listed under subsection (1).
12 (3) A person shall not initiate, expand, replace, relocate, or
13 acquire a positron emission tomography scanner service, a fixed or
14 mobile magnetic resonance imager service, or a fixed or mobile
15 computerized tomography scanner service under this section without
16 a certificate of need unless that person receives a written
17 acknowledgment of approval from the department under subsection
18 (2).
19 (4) As used in this section:
20 (a) "Facility fee" means a fee imposed to cover the cost of
21 operation of the facility and not the cost of the service provided.
22 (b) "Outpatient imaging center" means a facility in which
23 imaging services will be provided, that is not owned or operated by
24 a person who owns or operates a hospital, and that does not use a
25 facility fee.
