A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending sections 2617 and 2619 (MCL 333.2617 and 333.2619),
section 2619 as added by 1984 PA 82.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2617. The health information system shall must include
2 statistics relative to:
3 (a) The causes, effects, extent, and nature of illness and
4 disability of the people of this state, or a grouping of its
5 people, which may include the incidence and prevalence of various

1 acute and chronic illnesses and infant and maternal morbidity and
2 mortality.
3 (b) The impact of illness and disability of the people of this
4 state on the economy of this state and on other aspects of the
5 well-being of its people or a grouping of its people.
6 (c) Environmental, social, and other health hazards and health
7 knowledge and practices of the people of this state, including, but
8 not limited to, any variation in environmental exposure that may be
9 linked to cancer incidence and outcomes recorded under section
10 2619.
11 (d) Determinants of health and nutritional practices and
12 status, including behavior related to health.
13 (e) Health resources, which may include health care
14 institutions.
15 (f) The utilization of health care, which may include the
16 utilization of ambulatory health services by specialties and types
17 of practice of the health professionals providing the services, and
18 services of health facilities and agencies as that term is defined
19 in section 20106 and other health care institutions.
20 (g) Health care costs and financing, which may include the
21 trends in health care prices and costs, the sources of payments for
22 health care services, and federal, state, and local governmental
23 expenditures for health care services.
24 Sec. 2619. (1) The department shall establish a registry to
25 record cases of cancer and other specified tumorous and
26 precancerous diseases that occur in the state, and to record
27 information concerning these cases, including any potential
28 relationship with environmental exposures, as the department
29 considers necessary and appropriate in order to conduct

1 epidemiologic surveys of cancer and cancer-related diseases in the
2 state.
3 (2) Each diagnosed case of cancer and other specified tumorous
4 and precancerous diseases shall must be reported to the department
5 pursuant to under subsection (4), or reported to a cancer reporting
6 registry if the cancer reporting registry meets standards
7 established pursuant to under subsection (4) to ensure the accuracy
8 and completeness of the reported information. A person or facility
9 required to report a diagnosis pursuant to under subsection (4) may
10 elect to report the diagnosis to the state through an existing
11 cancer registry only if the registry meets minimum reporting
12 standards established by the department.
13 (3) The department shall maintain comprehensive records of all
14 reports submitted pursuant to under this section. These reports
15 shall be are subject to the same requirements of confidentiality as
16 provided in section 2631 for data or records concerning medical
17 research projects.
18 (4) The director shall promulgate rules which that provide for
19 all of the following:
20 (a) A list of tumorous and precancerous diseases other than
21 cancer to be reported pursuant to under subsection (2).
22 (b) The quality and manner in which the cases and other
23 information described in subsection (1) are reported to the
24 department.
25 (c) The terms and conditions under which records disclosing
26 the name and medical condition of a specific individual and kept
27 pursuant to this section are released by the department.
28 (5) This section does not compel an individual to submit to
29 medical or department examination or supervision.

1 (6) The department shall partner with other governmental
2 entities to develop a user-friendly interface that visually
3 demonstrates, in a map format, the geographic variation in
4 environmental exposures that are potentially linked to cancer
5 incidence and outcomes in this state. The department shall
6 highlight cancer clusters on the user-friendly interface that may
7 be useful for scientific investigation. In developing the user-
8 friendly interface under this subsection, the department shall do
9 all of the following:
10 (a) Utilize a community-engaged approach that provides
11 opportunities for community involvement at all stages during the
12 investigation of unusual patterns of the occurrence of cancer,
13 including, but not limited to, reporting of suspected cancer
14 clusters, reviewing and discussing the methodological approaches
15 for assessing cancer clusters, and broadly sharing information with
16 community members.
17 (b) Follow best practice guidelines from the Centers for
18 Disease Control and Prevention during all phases of a cancer
19 cluster assessment.
20 (c) Use innovative statistical methods, software tools, and
21 analytic approaches to analyze cancer rates and detect cancer
22 clusters.
23 (7) (6) The department may contract for the collection and
24 analysis of, and research related to, the epidemiologic data
25 required under this section.
26 (8) (7) Within 2 years after the effective date of this
27 section, the The department shall begin evaluating evaluate the
28 reports collected pursuant to under subsection (2). The Not later
29 than June 30 each year, the department shall publish and make

1 available to the public reports summarizing the information
2 collected. The first summary report shall be published not later
3 than 180 days after the end of the first 2 full calendar years
4 after the effective date of this section. Subsequent annual summary
5 reports shall be made on a full calendar year basis and published
6 not later than 180 days after the end of each calendar year.
7 (8) Reporting pursuant to subsection (2) shall begin the next
8 calendar year after the effective date of this section.
9 (9) This section shall take effect July 1, 1984.
