A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding part 92.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 PART 92
2 SOIL HEALTH AND CONSERVATION
3 Sec. 9201. As used in this part:
4 (a) "Bulk soil" means a soil product available for purchase in
5 bulk quantities, typically sold by cubic yard.
6 (b) "Class 1 compostable material" means that term as defined

1 in section 11502.
2 (c) "Potting soil" means a substrate product available for
3 purchase for planting and growing for horticultural or agricultural
4 purposes, typically packaged and sold in quantities of 1 cubic yard
5 or less, and that may consist of a combination of organic and
6 inorganic material to provide necessary aeration, nutrients,
7 drainage, or pH balance to facilitate plant growth. Potting soil
8 includes, but is not limited to, peat moss, sphagnum peat moss,
9 bark, perlite, vermiculite, coir, fertilizer, or wetting agents.
10 (d) "Prepackaged soil" means a soil product packaged and
11 available for purchase, typically sold in quantities of 1 cubic
12 yard or less, that may consist of a combination of organic
13 material, water, air, and minerals including, but not limited to,
14 sand, silt, or clay.
15 Sec. 9203. Beginning January 1, 2027, bulk soil, prepackaged
16 soil, and potting soil sold or offered for sale in this state must
17 contain at least 5% compost derived from class 1 compostable
18 material.
19 Sec. 9205. Beginning January 1, 2027, bulk soil, prepackaged
20 soil, and potting soil sold or offered for sale in this state must
21 have a label printed in 12-point bold type that states the
22 percentage of class 1 compostable material contained in the bulk
23 soil, prepackaged soil, or potting soil, and all of the information
24 required under section 11563(1). If a label is not feasible, the
25 product receipt or delivery receipt must contain a notice printed
26 in 12-point bold type that states the percentage of class 1
27 compostable material contained in the bulk soil, prepackaged soil,
28 or potting soil, and all of the information required under section
29 11563(1).
