A bill to amend 1931 PA 328, entitled
"The Michigan penal code,"
by amending section 50c (MCL 750.50c), as amended by 2006 PA 517.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 50c. (1) As used in this section:
2 (a) "Dog handler" means a peace officer who has successfully
3 completed training in the handling of a police dog pursuant to a
4 policy of the law enforcement agency that employs that peace
5 officer.

1 (b) "Physical harm" means any injury to a dog's or horse's
2 physical condition.
3 (c) "Police dog" means a dog used by a law enforcement agency
4 of this state or of a local unit of government of this state that
5 is trained for law enforcement work and subject to the control of a
6 dog handler.
7 (d) "Police horse" means a horse used by a law enforcement
8 agency of this state or of a local unit of government of this state
9 for law enforcement work.
10 (e) "Search and rescue dog" means a dog that is trained for,
11 being trained for, or engaged in a search and rescue operation.
12 (f) "Search and rescue operation" means an effort conducted at
13 the direction of an agency of this state or of a political
14 subdivision of this state to locate or rescue a lost, injured, or
15 deceased individual.
16 (g) "Serious physical harm" means any injury to a dog's or
17 horse's physical condition or welfare that is not necessarily
18 permanent but that constitutes substantial body disfigurement, or
19 that seriously impairs the function of a body organ or limb.
20 (2) A person shall not intentionally kill or cause serious
21 physical harm to a police dog or police horse or a search and
22 rescue dog.
23 (3) A person shall not intentionally cause physical harm to a
24 police dog or police horse or a search and rescue dog.
25 (4) A person shall not intentionally harass or interfere with
26 a police dog or police horse or search and rescue dog lawfully
27 performing its duties.
28 (5) A person who is committing or attempting to commit a crime
29 shall not kill or cause serious physical harm to a police dog or

1 police horse or a search and rescue dog.
2 (6) (5) A person who violates subsection (2) is guilty of a
3 felony punishable by imprisonment for not more than 5 years, or a
4 fine of not more than $10,000.00, or both.
5 (7) (6) Except as provided in subsection (7), (8), a person
6 who violates subsection (3) or (4) is guilty of a misdemeanor
7 punishable by imprisonment for not more than 1 year, or a fine of
8 not more than $5,000.00, or both.
9 (8) (7) A person who violates subsection (3) or (4) while
10 committing a crime is guilty of a felony punishable by imprisonment
11 for not more than 2 years, or a fine of not more than $15,000.00,
12 or both.
13 (9) A person who violates subsection (5) is guilty of a felony
14 punishable by imprisonment for not more than 2 years, a fine of not
15 more than $10,000.00, or both.
16 (10) (8) This section does not prohibit an individual from
17 being charged with, convicted of, or punished for any other
18 violation of law committed by that individual while violating this
19 section.
20 Enacting section 1. This amendatory act may be known as
21 "Dozer's law".
22 Enacting section 2. This amendatory act takes effect 90 days
23 after the date it is enacted into law.
