SUMMARY:
Senate Bill 1056 would amend the Social Welfare Act to allow an eligible individual to receive
coverage under the state Medical Assistance Program for donor human milk for their infant for
up to two years after childbirth or two years after they are discharged from the hospital after
childbirth or if both of the following conditions are met:
• A provider has written a prescription for the donor human milk.
• Either of the following applies:
o The birthing person is temporarily or permanently unable to provide milk.
o The infant was born before the thirty-fourth week of the pregnancy or weighed
less than 1,800 grams at birth.
The bill would take effect January 1, 2026.

FISCAL IMPACT:
This bill could cost the state Medicaid program up to $26.7 million Gross ($9.3 million GF/GP)
and would incur indeterminate administrative costs for the Department of Health and Human
Services (DHHS) related to any waiver request to amend the Medicaid State Plan. Costs would
depend on utilization, supply of donated human milk, agreed-upon service reimbursement
rates, and the annually updated Federal Medical Assistance Percentage (FMAP). Estimates are
based on House Fiscal Agency assumptions for proxy variables and the FY 2024-25 FMAP,
which is 65.13%.
