SUMMARY:
House Bill 6022 would amend the Tobacco Products Tax Act to allow cities, townships,
villages, counties, and other local units of government or political subdivisions to adopt
ordinances and regulations pertaining to the sale and licensure of tobacco products. The bill
would provide that the Tobacco Products Tax Act does not prohibit or in any way restrict those
entities from imposing a requirement or a prohibition pertaining to the sale or licensure of
tobacco products. 1
The act now prohibits any of those entities from imposing any new requirement or prohibition
pertaining to the sale or licensure of tobacco products for distribution purposes, but this
prohibition does not invalidate or otherwise restrict such a requirement or prohibition that
existed on March 15, 1994 (the effective date of the act).

FISCAL IMPACT:
House Bill 6022 would have no fiscal impact on the state and would have an indeterminate
fiscal impact on local units of government. The fiscal impact on local units of government is
indeterminate because any fiscal impact to a local unit of government would be predicated on
whether a local unit of government decides to impose a requirement or prohibition on the sale
or licensure of tobacco products and what requirements or prohibitions are included by the
local unit of government.
