A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 7404a.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 7404a. (1) An individual who meets all of the following
2 requirements is not in violation of section 7401, 7403, or 7404 for
3 creating, manufacturing, possessing, or using psilocyn:
4 (a) The individual is 18 years of age or older.
5 (b) The individual possesses not more 2 ounces of a substance
6 that contains psilocyn.

1 (c) The individual possesses the substance containing psilocyn
2 only for personal use.
3 (d) The individual possesses a medical record that
4 demonstrates the individual has a diagnosis of post-traumatic
5 stress disorder.
6 (2) An individual who meets all of the following requirements
7 is not in violation of section 7401, 7403, or 7404 for creating,
8 manufacturing, possessing, or using psilocybin:
9 (a) The individual is 18 years of age or older.
10 (b) The individual possesses not more than 2 ounces of a
11 substance that contains psilocybin.
12 (c) The individual possesses the substance containing
13 psilocybin only for personal use.
14 (d) The individual possesses a medical record that
