A bill to amend 1976 PA 451, entitled
"The revised school code,"
(MCL 380.1 to 380.1852) by adding section 1278e.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1278e. (1) By not later than April 1, 2026, the
2 department shall publish on its website a list of recommended
3 curriculum companies and assessment companies for use by school
4 districts, intermediate school districts, and public school
5 academies. The curricular programs developed by curriculum
6 companies recommended by the department under this section must do

1 all of the following:
2 (a) Include curriculums that align with this state's academic
3 standards under this act and include comprehensive coverage of all
4 required subject areas. Comprehensive coverage may include subject
5 area coverage supplied by a combination of curriculum providers.
6 (b) Provide evidence of effectiveness through independent
7 research or other reliable data supporting improved student
8 outcomes.
9 (c) Include strategies for differentiating instruction and
10 ensuring accessibility for all students, including students with
11 disabilities.
12 (d) Offer robust professional development and professional
13 learning resources and ongoing support for educators.
14 (e) Be available in digital and print formats, be compatible
15 with multiple platforms, and comply with all applicable
16 accessibility standards.
17 (f) Allow for customization and flexibility to meet the
18 specific needs of individual schools and school districts.
19 (g) Provide clear and detailed information on all costs and
20 licensing options.
21 (h) Ensure the provision of high-quality, accurate, and
22 unbiased content that is regularly reviewed and updated.
23 (i) Offer comprehensive customer support and be willing to
24 provide references from current users.
25 (2) The department shall ensure that the assessment companies
26 recommended under subsection (1) provide a variety of assessments
27 that align with all state and federal requirements and include
28 diagnostic, formative and summative assessments.
29 (3) The requirements of subsection (1) are in addition to any

1 other requirements imposed by the department for inclusion on the
2 list of recommended curriculum companies and assessment companies.
3 (4) The board of a school district or intermediate school
4 district or board of directors of a public school academy is not
5 required to employ a curriculum company or assessment company or
6 implement a curriculum developed by a company recommended by the
7 department under subsection (1).
8 (5) By not later than April 1, 2027, and each April 1
9 thereafter, the department shall update the list of recommended
10 curriculum companies and assessment companies developed under
11 subsection (1).
