HOUSE RESOLUTION NO.289
Rep. Wozniak offered the following resolution:
1 A resolution to declare June 27, 2024, as Public Employee
2 Freedom Day in the state of Michigan.
3 Whereas, The Supreme Court of the United States issued its
4 landmark decision in JANUS v. AFSCME on June 27, 2018, affirming
5 the constitutional rights of public sector employees regarding
6 union membership and dues; and
7 Whereas, The principles of free speech and freedom of
8 association guaranteed by the First Amendment ensure that public
9 sector employees have the right to make decisions that are in their
10 best interest; and
11 Whereas, Freedom in decision making empowers public sector
12 workers by granting them the ability to make individual choices

1 regarding their representation, fostering a climate of transparency
2 and accountability within public sector unions; and
3 Whereas, Safeguarding employee choices in representation
4 protects jobs and has contributed to a more equitable workplace
5 environment by safeguarding the rights of dissenting employees and
6 protecting their freedom from compelled political speech; and
7 Whereas, Michigan had the foresight to ensure workplace
8 freedom for public sector employees six years before the JANUS
9 decision, further demonstrating Michigan’s unwavering dedication to
10 the principles of fairness and competition in employment; and
11 Whereas, The principles articulated in the JANUS decision
12 continue to resonate as a cornerstone of constitutional
13 jurisprudence, serving as a bulwark against coercion and ensuring
14 the protection of individual liberties; and
15 Whereas, June 27th marks the sixth anniversary of the JANUS
16 court decision as it continues to have a profound impact on
17 safeguarding the constitutional rights of public sector employees
18 across the United States; now, therefore, be it
19 Resolved by the House of Representatives, That the members of
20 this legislative body declare June 27, 2024, as Public Employee
21 Freedom Day in the state of Michigan.
