A bill to amend 1978 PA 368, entitled
"Public health code,"
(MCL 333.1101 to 333.25211) by adding section 5143.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 5143. (1) Subject to subsection (14), the advisory
2 council on pediatric autoimmune neuropsychiatric disorder
3 associated with streptococcal infections is created within the
4 department.
5 (2) The advisory council must consist of the following 15

1 members, appointed by the director:
2 (a) An immunologist who is practicing in this state and has
3 experience treating individuals with pediatric autoimmune
4 neuropsychiatric disorder associated with streptococcal infections
5 and pediatric acute neuropsychiatric syndrome and the use of
6 intravenous immunoglobulin.
7 (b) A health professional who is licensed under article 15 who
8 has expertise in treating individuals with pediatric autoimmune
9 neuropsychiatric disorder associated with streptococcal infections
10 and pediatric acute neuropsychiatric syndrome and autism.
11 (c) A representative of PANDAS/PANS Advocacy and Support.
12 (d) A physician who is licensed under article 15 to engage in
13 the practice of osteopathic medicine and surgery who has experience
14 treating individuals with pediatric autoimmune neuropsychiatric
15 disorder associated with streptococcal infections and pediatric
16 acute neuropsychiatric syndrome.
17 (e) A medical researcher with experience conducting research
18 concerning pediatric autoimmune neuropsychiatric disorder
19 associated with streptococcal infections, pediatric acute
20 neuropsychiatric syndrome, obsessive-compulsive disorder, tic
21 disorder, and other neurological disorders.
22 (f) A dietitian who is practicing in this state and who
23 provides services to children with autism spectrum disorder,
24 attention-deficit hyperactivity disorder, and other
25 neurodevelopmental conditions.
26 (g) A representative of a professional organization in this
27 state for school psychologists.
28 (h) A child psychiatrist who has experience treating
29 individuals with pediatric autoimmune neuropsychiatric disorder

1 associated with streptococcal infections and pediatric acute
2 neuropsychiatric syndrome.
3 (i) A representative of a professional organization in this
4 state for school nurses.
5 (j) A pediatrician who has experience treating individuals
6 with pediatric autoimmune neuropsychiatric disorder associated with
7 streptococcal infections and pediatric acute neuropsychiatric
8 syndrome.
9 (k) A representative of an organization focused on autism.
10 (l) A parent of a child who has been diagnosed with pediatric
11 autoimmune neuropsychiatric disorder associated with streptococcal
12 infections or pediatric acute neuropsychiatric syndrome and autism.
13 (m) An individual who is licensed under article 15 as a
14 licensed master's social worker or licensed bachelor's social
15 worker.
16 (n) A representative of the office of special education within
17 the department of education.
18 (o) A representative of the general public.
19 (3) The director, or the director's designee, shall serve as
20 an ex officio member of the advisory council without the right to
21 vote.
22 (4) The director shall appoint the members of the advisory
23 council not more than 90 days after the effective date of this
24 section.
25 (5) Members of the advisory council serve for a term of 4
26 years or until a successor is appointed.
27 (6) If a vacancy occurs on the advisory council, the director
28 shall make an appointment for the unexpired term in the same manner
29 as the original appointment.

1 (7) The director may remove a member of the advisory council
2 for incompetence, dereliction of duty, malfeasance, misfeasance, or
3 nonfeasance in office, or any other good cause.
4 (8) The director shall call the first meeting of the advisory
5 council not later than 90 days after the effective date of this
6 section. At the first meeting, the advisory council shall elect
7 from among its members a chairperson and other officers as it
8 considers necessary or appropriate. After the first meeting, the
9 advisory council shall meet at the call of the chairperson or if
10 requested by a majority of the members of the advisory council.
11 (9) A majority of the members of the advisory council
12 constitute a quorum for transacting business. A majority of the
13 members present and serving are required for official action of the
14 advisory council.
15 (10) The advisory council shall conduct its business in
16 compliance with the open meetings act, 1976 PA 267, MCL 15.261 to
17 15.275.
18 (11) A writing prepared, owned, used, in the possession of, or
19 retained by the advisory council in performing an official function
20 is subject to the freedom of information act, 1976 PA 442, MCL
21 15.231 to 15.246.
22 (12) A member of the advisory council is not entitled to
23 compensation for service on the advisory council, but the advisory
24 council may reimburse a member for actual and necessary expenses
25 incurred in serving.
26 (13) Subject to subsection (14), not later than 1 year after
27 the members are appointed under subsection (4) and annually
28 thereafter, the advisory council shall submit a report to the
29 legislature with recommendations on all of the following:

1 (a) Practice guidelines for the diagnosis and treatment of
2 pediatric autoimmune neuropsychiatric disorder associated with
3 streptococcal infections and pediatric acute neuropsychiatric
4 syndrome.
5 (b) Mechanisms to increase clinical awareness and education
6 regarding pediatric autoimmune neuropsychiatric disorder associated
7 with streptococcal infections and pediatric acute neuropsychiatric
8 syndrome among physicians, school-based health centers, and
9 providers of mental health services.
10 (c) Outreach to educators and parents to increase awareness of
11 pediatric autoimmune neuropsychiatric disorder associated with
12 streptococcal infections and pediatric acute neuropsychiatric
13 syndrome.
14 (d) Development of a network of volunteer experts on the
15 diagnosis and treatment of pediatric autoimmune neuropsychiatric
16 disorder associated with streptococcal infections and pediatric
17 acute neuropsychiatric syndrome to assist in education and
18 outreach.
19 (e) Any other recommendation that the advisory council
20 considers appropriate.
21 (14) The advisory council is abolished upon submitting the
22 fourth report required under subsection (13).
23 (15) As used in this section, "advisory council" means the
24 advisory council on pediatric autoimmune neuropsychiatric disorder
25 associated with streptococcal infections created in subsection (1).
26 Enacting section 1. This amendatory act takes effect 90 days
27 after the date it is enacted into law.
