A bill to amend 2022 PA 180, entitled
"An act to establish a student mental health apprenticeship
retention and training (SMART) internship grant program; to
prescribe conditions for the administration of the student mental
health apprenticeship retention and training (SMART) internship
grant program; to prescribe certain powers and duties of certain
state officers, agencies, and departments; and to require the
promulgation of rules,"
by amending section 3 (MCL 388.1953).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:

1 Sec. 3. (1) The department shall create and administer a
2 student mental health apprenticeship retention and training (SMART)
3 internship grant program to provide grants to designated recipients
4 and to provide grants to field supervisors, field instructors, and
5 supervisors as described in this act. It is the intent of the
6 legislature that the grant program lead to, at a minimum, both of
7 the following:
8 (a) The the provision of paid and educationally meaningful
9 internship practicum in school settings for designated recipients.
10 (b) The utilization of funding obtained by a public school
11 under section 31o of the state school aid act of 1979, 1979 PA 94,
12 MCL 388.1631o, as permitted under that section, to hire designated
13 recipients who obtained a grant under this act.
14 (2) The department shall administer grant funding through the
15 grant program to designated recipients through agreements. The
16 agreements described in this subsection must meet the following
17 criteria:
18 (a) Subject to subsection (4), the department shall administer
19 grant funding as described in this subsection in an amount per
20 eligible designated recipient that is equal to $25.00 per hour for
21 each hour spent in an intern capacity for up to 20 hours per week
22 of an internship in a public school that occurs over a 30-week
23 period in a school year or a lump sum amount equal to $15,000.00
24 for up to 20 hours per week of an internship in a public school
25 that occurs over a 30-week period in a school year. The lump sum
26 amount described in this subdivision subsection must be paid at the
27 end of the 30-week period described in this subdivision.
28 subsection. As used in this subdivision, subsection, "eligible
29 designated recipient" means a designated recipient to whom both

1 either of the following apply:
2 (i) Either of the following:applies
3 (a) (A) The individual is enrolled in a graduate-level mental
4 health professional program described in section 1(c), who is in
5 the first year of an internship period required by the program, and
6 who is serving as a substitute teacher or in a paraprofessional
7 role in a public school as described in this subdivision subsection
8 or who is in a supervised role in a public school as described in
9 this subdivision subsection and following best-practice training
10 and supervision requirements as indicated by national standards set
11 forth by the appropriate national professional organizations. As
12 used in this sub-subparagraph, subdivision, "supervised role" means
13 a role in which the individual is supervised by a field supervisor,
14 field instructor, or supervisor while he or she the individual is
15 serving in the role.
16 (b) (B) The individual is enrolled in a graduate-level mental
17 health professional program described in section 1(c), who is in
18 the second year of an internship period required by the program,
19 and who is in a supervised role in a public school as described in
20 this subdivision subsection and following best-practice training
21 and supervision requirements as indicated by national standards set
22 forth by the appropriate national professional organizations. As
23 used in this sub-subparagraph, subdivision, "supervised role" means
24 a role in which the individual is supervised by a field supervisor,
25 field instructor, or supervisor while he or she the individual is
26 serving in the role.
27 (ii) At least 1 of the following applies to the individual's
28 work as described under this subdivision:
29 (A) The individual is interning in a discipline that has been

1 designated as critical shortage by the superintendent of public
2 instruction for the immediately preceding school fiscal year under
3 section 38 of the public school employees retirement act of 1979,
4 1980 PA 300, MCL 38.1361.
5 (B) The individual is interning in a public school in which
6 not less than 50% of pupils enrolled are eligible for free or
7 reduced-price meals under the Richard B. Russell national school
8 lunch act, 42 USC 1751 to 1769j.
9 (C) The individual is interning in a public school that
10 received funding under section 22d of the state school aid act of
11 1979, 1979 PA 94, MCL 388.1622d, in the immediately preceding
12 school fiscal year.
13 (b) Include a requirement that the designated recipient who
14 receives funding through the grant program shall work at a public
15 school for not less than 3 school years as of the date of the
16 agreement.
17 (3) A payment or payments of funding through the grant program
18 must be made as follows to designated recipients, pursuant to an
19 agreement between the designated recipient, the public school in
20 which he or she the designated recipient is interning as described
21 in subsection (2), and the graduate-level mental health
22 professional program described in section 1(c) that he or she the
23 designated recipient is enrolled:
24 (a) On the same pay period or schedule offered to other
25 educational professionals at the public school in which the
26 designated recipient is serving for purposes of qualifying for
27 funding under this act.
28 (b) Through 1 lump-sum payment on the date on which the
29 designated recipient's service for purposes of qualifying for

1 funding under this act ends.
2 (4) Both of the following apply to funding distributions as
3 described in subsection (2), as applicable:
4 (a) For recipients of the funding who receive $25.00 per hour
5 as described in subsection (2):
6 (i) If the recipient permanently ceases to satisfy the
7 qualification requirements that initially made the recipient
8 eligible for funding under this act either by his or her the
9 recipient's own initiative, by initiative of the public school in
10 which he or she the recipient was interning, or by initiative of
11 the graduate-level mental health professional program described in
12 section 1(c), payments must stop as of the date on which this
13 occurs.
14 (ii) If the recipient temporarily ceases to satisfy the
15 qualification requirements that initially made the recipient
16 eligible for funding under this act because he or she the recipient
17 is relocating to intern in another public school or due to a leave
18 of absence, payments must stop during the period which the
19 individual does not meet the requirements, but may be continued
20 when the individual again meets the qualification requirements, but
21 must not be continued beyond 30 weeks from the date the individual
22 initially started his or her the individual's internship at the
23 public school under subsection (2).
24 (b) For recipients of the funding who receive the lump sum of
25 $15,000.00 as described in subsection (2):
26 (i) If the recipient permanently ceases to satisfy the
27 qualification requirements that initially made the recipient
28 eligible for funding under this act either by his or her the
29 recipient's own initiative, by initiative of the public school in

1 which he or she the recipient was interning, or by initiative of
2 the graduate-level mental health professional program described in
3 section 1(c), the recipient may receive a pro rata amount of the
4 lump sum that reflects the number of hours the individual interned
5 at the public school while meeting the qualification requirements
6 for funding under this act.
7 (ii) If the recipient temporarily ceases to satisfy the
8 qualification requirements that initially made the recipient
9 eligible for funding under this act because he or she the recipient
10 is relocating to intern in another public school or due to a leave
11 of absence, the individual is still eligible to receive the full
12 amount of the lump sum if he or she the individual completes all of
13 the qualification requirements for funding under this act.
14 (5) The department may, for extenuating circumstances, make a
15 debt or expense repayment to a designated recipient before or
16 during each year of service that the designated recipient will
17 complete or is completing for purposes of qualifying for funding
18 under this act.
19 (6) Each state university that designated recipients are
20 enrolled in for the graduate-level mental health professional
21 program described in section 1(c) may continue implementing any
22 existing evaluation processes required as part of any
23 certification, licensing, or approval requirements associated with
24 serving as a school mental health professional. For purposes of
25 this act, the results from an evaluation described in this
26 subsection may be used as a reason for the individual's
27 disqualification for grant funding under this act.
28 (7) A designated recipient that receives a grant under this
29 act shall submit any evaluations he or she the designated recipient

1 receives as described in subsection (6) and any evaluations
2 received from the public school in which he or she the designated
3 recipient is interning as described in subsection (2) to the
4 department. Upon receiving an evaluation as described in this
5 subsection, the department shall determine whether the designated
6 recipient is still eligible to receive grant funding under this
7 section or whether the recipient is subject to subsection (4) and
8 shall notify the recipient of its determination.
9 (8) The department shall administer grant funding through the
10 grant program to field supervisors, field instructors, or
11 supervisors. A grant to a field supervisor, field instructor, or
12 supervisor under this subsection must not exceed $250.00 for each
13 designated recipient that he or she the field supervisor, field
14 instructor, or supervisor supervises.
15 (9) A designated recipient who receives a grant under this act
16 is not prohibited from applying for another grant under this act if
17 he or she the designated recipient meets the qualifications for
18 grant funding under this act.
