SUMMARY:
House Bill 5743 would amend 1963 PA 17, known as the Good Samaritan act, to provide
that an individual who voluntarily applies bleeding control to another individual (through
pressure, a dressing, packing, or a tourniquet), when they have no duty to do so and are
acting in a good-faith response to an emergency medical situation, is not liable in a civil
action for damages resulting from an act or omission in applying the bleeding control,
except for an act or omission that constitutes gross negligence or willful and wanton
misconduct.

House Bill 5742 would amend 2006 PA 23, which regulates certain health clubs regarding
potential medical emergencies, to update a reference to the Good Samaritan act to reflect
changes made by HB 5743. (Because House Bill 5743 would add a new section to the end
of the Good Samaritan act, the range of sections used to cite it would also change.)

Neither bill could take effect unless both bills were enacted.
FISCAL IMPACT:
House Bills 5742 and 5743 would not have any impact on the state or local units of
government.
