A bill to amend 1978 PA 368, entitled
"Public health code,"
by amending sections 9208 and 9227 (MCL 333.9208 and 333.9227),
section 9208 as amended by 2013 PA 120 and section 9227 as amended
by 2006 PA 91.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 9208. (1) A parent, guardian, or person in loco parentis
2 applying to have a child registered for the first time in a school

1 in this state, and, beginning January 1, 2014, a parent, guardian,
2 or person in loco parentis of a child entering the seventh grade,
3 and, beginning in the 2025-2026 school year, a parent, guardian, or
4 person in loco parentis of a child entering the twelfth grade,
5 shall present to school officials, at the time of registration or
6 not later than the first day of school, a certificate of
7 immunization or statement of exemption under section 9215.
8 (2) A teacher or principal shall not permit a child to enter
9 or attend school unless a certificate indicating that a minimum of
10 1 dose of an immunizing agent against each of the diseases
11 specified by the department has been received and certified to by a
12 health professional or local health department. A parent, guardian,
13 or person in loco parentis having a child registered with only
14 these minimum doses of immunizing agents shall present an updated
15 certificate of immunization within 4 months after initial
16 attendance showing that the immunizations have been completed as
17 prescribed by the department.
18 (3) The department annually shall provide a report showing a
19 year-to-year comparison of the percentage of children by age who
20 are immunized appropriately upon entering the seventh grade and
21 twelfth grade.
22 Sec. 9227. (1) The department shall promulgate rules to
23 implement this part, including, but not limited to, rules governing
24 all of the following:
25 (a) Age periods for immunizations.
26 (b) The minimum ages at which immunization may be commenced.
27 (c) The minimum number of doses required during a specified
28 time period.
29 (d) Minimum levels of immunization for children in school.

1 (e) Reporting under section 9206(3).
2 (f) The acquisition, maintenance, and dissemination of
3 information contained in the registry. established under section
4 9207.
5 (2) The department shall promulgate rules to implement the
6 expansion of the registry to include the reporting and recording of
7 additional information, such as including, but not limited to, lead
8 screening performed on children.
9 (3) By 1 year after the effective date of the amendatory act
10 that added this subsection, the department shall promulgate rules
11 under subsection (1) that adopt, by reference, the immunization
12 schedule recommended by the Advisory Committee on Immunization
13 Practices of the Centers for Disease Control and Prevention that is
14 in existence on the effective date of the amendatory act that added
15 this subsection. If the Centers for Disease Control and Prevention
16 revises the immunization schedule after the effective date of the
17 amendatory act that added this subsection, the department may
18 promulgate rules to incorporate the revision by reference.
19 Enacting section 1. This amendatory act does not take effect
20 unless all of the following bills of the 102nd Legislature are
21 enacted into law:
