A bill to amend 1976 PA 451, entitled
"The revised school code,"
by amending section 1177 (MCL 380.1177), as amended by 2013 PA 121.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 1177. (1) A child enrolling in a public or nonpublic
2 school for the first time, or, beginning in the 2014-2015 school
3 year, enrolling in grade 7 for the first time, or, beginning in the
4 2025-2026 school year, enrolling in grade 12 for the first time
5 shall submit 1 of the following:
6 (a) A statement signed by a physician that the child has been

1 tested for and immunized or protected against diseases specified by
2 the director of the department of community health and human
3 services.
4 (b) A statement signed by a parent or guardian to the effect
5 that the child has not been immunized because of religious
6 convictions or other objection to immunization.
7 (c) A statement signed by a physician that certifies that the
8 child is in the process of complying with all immunization
9 requirements.
10 (2) In addition, the parent or guardian of each child
11 enrolling in kindergarten for the first time shall submit a
12 statement signed by a district, county, or city health department
13 director stating that the child has been administered the
14 department of community health and human services preschool vision
15 screening test, or a statement signed by a licensed medical or
16 osteopathic physician or a licensed optometrist stating that the
17 child's eyes have been examined during the preschool years after
18 age 3 and before initial entrance. A vision test is not required if
19 there is a statement signed by a parent or guardian to the effect
20 that the child cannot be submitted to the test because of religious
21 convictions.
22 (3) Not later than November 1 of each year, the administrator
23 of each school shall provide the director of the department of
24 community health and human services with the immunization status of
25 each pupil in grades K through to 12 who enrolled in the school for
26 the first time, or, beginning in the 2014-2015 school year,
27 enrolled in grade 7 in the school for the first time, or, beginning
28 in the 2025-2026 school year, enrolled in grade 12 in the school
29 for the first time, between the immediately preceding January 1 and

1 the immediately preceding September 30, as well as a vision report
2 of each child entering kindergarten during that time period. This
3 information shall must be transmitted through the approved local
4 full-time health department, if available, and shall must be on
5 forms provided by the director of community the department of
6 health and human services or otherwise reported in a manner
7 approved by the director of the department of community health and
8 human services. Not later than February 1 of each year, the
9 administrator of each school shall provide an update to the report
10 due the previous November 1 to show the immunization status of each
11 pupil in grades K through to 12 who enrolled in the school for the
12 first time, or, beginning in the 2014-2015 school year, enrolled in
13 grade 7 in the school for the first time, or, beginning in the
14 2025-2026 school year, enrolled in grade 12 in the school for the
15 first time, during the calendar year ending the immediately
16 preceding December 31. This information shall must be transmitted
17 in the same manner as the report due the previous November 1.
18 (4) The Subject to section 9227(3) of the public health code,
19 1978 PA 368, MCL 333.9227, the department of community health and
20 human services shall promulgate rules, including rules identifying
21 the diseases specified under subsection (1)(a), for the
22 implementation of this section.
23 Enacting section 1. This amendatory act does not take effect
24 unless Senate Bill No. 875 of the 102nd Legislature is enacted into
25 law.
