A bill to amend 1945 PA 327, entitled
"Aeronautics code of the state of Michigan,"
by amending section 135 (MCL 259.135), as amended by 1982 PA 466.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 135. (1) A political subdivision of this state is
2 empowered to may accept federal or other assistance in the
3 acquisition, construction, enlargement, improvement, maintenance,
4 equipment, or operation of airports, landing fields, and other
5 aeronautical facilities.
6 (2) A political subdivision of this state, whether acting

1 alone or jointly with another political subdivision or with the
2 state, shall not submit directly to the administrator of the
3 federal aviation administration Federal Aviation Administration or
4 its successor agency any project application under the provisions
5 of an act of Congress for airport and airway systems, unless the
6 project and the project application have been first approved by the
7 commission.
8 (3) A Except as otherwise provided in this subsection, a
9 political subdivision shall not directly accept, receive, receipt
10 for, or disburse any funds granted by the United States for the
11 purpose of acquisition, construction, enlargement, maintenance,
12 equipment, or improvement of airports, landing fields, or other
13 aeronautical facilities, but it shall designate the commission as
14 its agent and in its behalf to accept, receive, receipt for, and
15 disburse such the funds described in this subsection. A political
16 subdivision shall enter into an agreement with the commission which
17 shall must prescribe the terms and conditions of the agency in
18 accordance with federal laws, rules, and regulations and the
19 applicable laws of this state. Money paid over by the United States
20 government for the acquisition, construction, improvement,
21 enlargement, equipment, or maintenance of airports, landing fields,
22 or other aeronautical facilities shall must be channeled through
23 the state treasury and disbursed for and in behalf of the political
24 subdivision under the terms and conditions of the respective
25 grants. The disbursements shall must be made in accordance with the
26 accounting laws and procedures of this state. This subsection does
27 not apply to funds granted by the United States to a qualified
28 airport unless federal laws or regulations applicable to the funds
29 prohibit the direct acceptance or receipt by, or disbursement to, a
