A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
by amending section 61508 (MCL 324.61508), as added by 1995 PA 57,
and by adding section 503d.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 503d. Information on oil, gas, or mineral deposits or the
2 absence thereof obtained by a private person during authorized
3 exploration of land owned or controlled by the department of
4 natural resources is confidential and exempt from disclosure under

1 the freedom of information act, 1976 PA 442, MCL 15.231 to 15.246,
2 for 2 years after the information is submitted to the department
3 or, if a lease for the development of the oil, gas, or mineral
4 deposits is entered during that 2-year period, until the expiration
5 of the lease.
6 Sec. 61508. (1) The supervisor shall prescribe rules of order
7 or procedure in hearings or other proceedings before the supervisor
8 under this part. Rules promulgated or orders issued by the
9 supervisor shall be entered in full in a book to be kept for that
10 purpose by the supervisor. A copy of a rule or order, certified by
11 the supervisor, shall be received in evidence in the courts of this
12 state with the same effect as the original.
13 (2) A Subject to section 503d, a writing prepared, owned,
14 used, in the possession of, or retained by the supervisor in the
15 performance of an official function shall be made available to the
16 public in compliance with the freedom of information act, Act No.
17 442 of the Public Acts of 1976, being sections 15.231 to 15.246 of
18 the Michigan Compiled Laws.1976 PA 442, MCL 15.231 to 15.246.
