A bill to amend 1951 PA 51, entitled
"An act to provide for the classification of all public roads,
streets, and highways in this state, and for the revision of that
classification and for additions to and deletions from each
classification; to set up and establish the Michigan transportation
fund; to provide for the deposits in the Michigan transportation
fund of specific taxes on motor vehicles and motor vehicle fuels;
to provide for the allocation of funds from the Michigan
transportation fund and the use and administration of the fund for
transportation purposes; to promote safe and efficient travel for
motor vehicle drivers, bicyclists, pedestrians, and other legal
users of roads, streets, and highways; to set up and establish the
truck safety fund; to provide for the allocation of funds from the
truck safety fund and administration of the fund for truck safety
purposes; to set up and establish the Michigan truck safety

commission; to establish certain standards for road contracts for
certain businesses; to provide for the continuing review of
transportation needs within the state; to authorize the state
transportation commission, counties, cities, and villages to borrow
money, issue bonds, and make pledges of funds for transportation
purposes; to authorize counties to advance funds for the payment of
deficiencies necessary for the payment of bonds issued under this
act; to provide for the limitations, payment, retirement, and
security of the bonds and pledges; to provide for appropriations
and tax levies by counties and townships for county roads; to
authorize contributions by townships for county roads; to provide
for the establishment and administration of the state trunk line
fund, local bridge fund, comprehensive transportation fund, and
certain other funds; to provide for the deposits in the state trunk
line fund, critical bridge fund, comprehensive transportation fund,
and certain other funds of money raised by specific taxes and fees;
to provide for definitions of public transportation functions and
criteria; to define the purposes for which Michigan transportation
funds may be allocated; to provide for Michigan transportation fund
grants; to provide for review and approval of transportation
programs; to provide for submission of annual legislative requests
and reports; to provide for the establishment and functions of
certain advisory entities; to provide for conditions for grants; to
provide for the issuance of bonds and notes for transportation
purposes; to provide for the powers and duties of certain state and
local agencies and officials; to provide for the making of loans
for transportation purposes by the state transportation department
and for the receipt and repayment by local units and agencies of
those loans from certain specified sources; to investigate and
study the tolling of roads, streets, highways, or bridges; and to
repeal acts and parts of acts,"
(MCL 247.651 to 247.675) by adding section 11k.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 11k. (1) The bridge repair fund is created in the state
2 treasury.
3 (2) The state treasurer shall deposit money and other assets
4 received from section 695 of the income tax act of 1967, 1967 PA
5 281, MCL 206.695, or from any other source in the fund. The state
6 treasurer shall direct the investment of money in the fund and

1 credit interest and earnings from the investments to the fund.
2 (3) The department of transportation is the administrator of
3 the fund for audits of the fund.
4 (4) The department of transportation shall expend money from
5 the fund on appropriation, only for the rehabilitation or
6 replacement of bridges owned by this state and local road agencies
7 under the bridge bundling program as provided in this section.
8 (5) The department of transportation shall coordinate the
9 bundling of bridges program and issue contracts necessary for
10 planning, design, and construction work related to bridges selected
11 for the program. Bridges included in the program must be
12 structurally deficient. Bridges must be selected for inclusion in
13 the program subject to available funding and according to the
14 following order of priority:
15 (a) Bridges with an NBI condition rating of 0.
16 (b) Bridges with an NBI condition rating of 1.
17 (c) Bridges with an NBI condition rating of 2.
18 (d) Bridges with an NBI condition rating of 3.
19 (e) Bridges with an NBI condition rating of 4.
20 (6) The department of transportation shall provide a biannual
21 progress report on the bundling of bridges program and expenditures
22 of the bridge repair fund to the senate and house transportation
23 appropriations subcommittees, the state budget director, and the
24 senate and house fiscal agencies. The first report is due by
25 October 31, 2025. Updated reports are due April 30 and October 31
26 each year until the bundling of bridges program is completed. The
27 report must include, but not be limited to, all the following:
28 (a) A list of bridges with completed repairs through the
29 bridge bundling program.

1 (b) A list of bridges with scheduled repairs through the
2 bridge bundling program in the current fiscal year.
3 (c) The amount of funds expended to date from the bridge
4 repair fund through the bridge bundling program.
5 (d) The amount of funds remaining in the bridge repair fund
6 for expenditure through the bridge bundling program.
7 (7) As used in this section:
8 (a) "NBI" means the National Bridge Inventory.
9 (b) "Structurally deficient" means a bridge with an NBI
10 condition rating of 4 or less.
11 Enacting section 1. This amendatory act does not take effect
12 unless Senate Bill No. 852 of the 102nd Legislature is enacted into
13 law.
