SUMMARY:
House Bill 5522 would amend 1990 PA 195 to modify who is appointed to be part of the
state’s delegation to the Midwestern Higher Education Commission. 1 The bill would add
the director of the Department of Lifelong Education, Advancement, and Potential
(MiLEAP), or their designee, to the state’s delegation as a nonvoting member.
Presently, the state’s delegation consists of the following voting members:
• The governor or the governor’s designee.
• Two at-large members, appointed by the governor.
• A member of the Senate, appointed by the Senate majority leader.
• A member of the House of Representatives, appointed by the speaker of the House.
Additionally, a designee of the State Board of Education is appointed by the governor as a
nonvoting member. The act provides that nonvoting members are not members of the
Midwestern Higher Education Commission and do not have a vote in decisions made by
the state’s members.

BACKGROUND:
Twelve states in the Midwest are part of the Midwest Higher Education Compact, and
Michigan has been a member since 1990 when 1990 PA 195 was enacted. 2 The Midwest
is the newest of the four regional compacts nationally.
1990 PA 195 authorizes the state’s membership in both the compact and the commission.
Because the Michigan Department of Education focuses on K-12 education, and the
Midwest Commission focuses on higher education, the bill sponsor introduced House Bill
5522 to account for the creation of MiLEAP and include the department in the state’s
delegation.
