SUMMARY:
House Bill 5421 would amend the Michigan bottle law to establish minimum designated hours
of operation for bottle return facilities that are required to be operated by dealers under the act.
The act requires dealers that regularly sell beverages for consumption off the business’s
premises to provide a means for retuning empty returnable containers of any kind, size, and
brand sold or offered for sale by the dealer, for a cash refund of the deposit, within 100 yards
of the premises where beverages in returnable containers are sold.
The bill would require dealers to operate these facilities for, at least, the designated hours of
operation.
Designated hours of operation would mean either of the following:
• Except as provided below, between 8 a.m. and 11 p.m.
• If a dealer does not normally operate its premises between 8 a.m. and 11 p.m.,
any period of time between 8 a.m. and 11 p.m. when the premises is normally
operated by the dealer.

FISCAL IMPACT:
The bill is unlikely to affect costs or revenues for the Department of Environment, Great Lakes,
and Energy or for local governments.
