SUMMARY:
House Bill 5205 would amend section 3103 of the Natural Resources and Environmental
Protection Act (NREPA) to remove a prohibition on the Department of Environment, Great
Lakes, and Energy (EGLE) from promulgating rules under Part 31 of NREPA (Water
Resources Protection) that are not specifically authorized in statute.
Since December 31, 2006, other than rules relating to ballast water authorized in section 3112,
EGLE has been prohibited from promulgating new rules under Part 31. This prohibition was
enacted in 2004 PA 91.1

FISCAL IMPACT:
House Bill 5205 is unlikely to affect costs or revenues for EGLE or local governments.
