SUMMARY:
House Bill 5169 would amend the Public Health Code to require a health professional who is
seeing an individual who has given birth, in a pediatric or obstetric and gynecological setting,
to offer the mental health screening described below if the health professional determines at a
follow-up appointment or well child visit during the individual’s postpartum period (the period
after giving birth) that a mental health screening is appropriate for the individual. Any other
health professional could offer the mental health screening at a follow-up appointment or well
child visit to an individual who has given birth during the individual’s postpartum period or
until the child is 12 months old. The provisions described in this paragraph would apply
beginning January 1, 2026.
The Department of Health and Human Services (DHHS) could develop a tool to be used by
health professionals offering a screening as provided above, and a health professional could
also conduct the screening by using an evidence-based screening tool to assess an individual’s
maternal mental health or other postpartum risk factors.
If a health professional determines that an individual who has given birth may be in need of
mental health resources in addition to the screening described above, the health professional
could provide the individual with any of the following mental health resources:
• Mental health resources developed by DHHS.
• Information on postpartum mental health conditions and their symptoms.
• Treatment options for postpartum mental health conditions.
• Referrals the health professional considers appropriate for the individual.
• Any other information the health professional considers appropriate to support an
individual the health professional determines may be in need of additional support or
services.

House Bill 5170 would amend the Insurance Code to require an insurer that delivers, issues
for delivery, or renews a health insurance policy in Michigan to provide coverage for mental
health screenings during the postpartum period as described in HB 5169.

House Bill 5171 would amend the Social Welfare Act to require Medicaid to cover mental
health screenings during the postpartum period for Medicaid recipients as described in HB
5169.

FISCAL IMPACT:
House Bill 5169 would increase state expenditures to the Department of Health and Human
Services and local units of government by an indeterminate amount. The fiscal impact on state
expenditures would be dependent on the cost of developing and/or implementing a mental
health screening tool for new mothers. The fiscal impact on local units of government would
be dependent on any additional administrative or training costs associated with the
implementation of the mental health screening tool.
House Bill 5170 would not have a fiscal impact on the Department of Insurance and Financial
Services or on other units of state or local government.
House Bill 5171 would incur an upper-bound, estimated cost of $2.3 million Gross ($788,700
GF/GP) 1 per year for the Michigan Medicaid program, assuming every eligible recipient
receives a Medicaid-provided mental health screening during the postpartum period. Median
national reimbursements for Medicaid-provided “other psychiatric diagnostic procedures,
psychotherapy services and procedures” were $57.45 2 per encounter, as of 2022. The number
of births financed by Medicaid in 2021 totaled 39,585 individuals, 3 and was used as a proxy
variable for the number of pregnant women that would be eligible for the Medicaid-provided
mental health screenings during the postpartum period.
