A bill to amend 1986 PA 268, entitled
"Legislative council act,"
by amending section 602 (MCL 4.1602), as added by 2018 PA 340.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 602. (1) The house fiscal agency shall prepare, for each
2 bill that is scheduled for a hearing before a standing committee of
3 the house of representatives, a fiscal analysis that contains all
4 of the following:
5 (a) A summary that explains the changes the bill would make to

1 existing law.
2 (b) An estimate of the potential impact or amount by which the
3 bill would increase or decrease governmental revenues and
4 expenditures, and which funds the bill would affect. If federal
5 funding received by the this state would be affected by the bill,
6 the analysis must include an estimate of that effect.
7 (c) If the bill would increase or decrease state taxes or
8 fees, the analysis may include an estimate of the impact on payers
9 of the taxes or fees.
10 (d) Subject to subsection (4), if the bill involves criminal
11 justice, economic stability, education, employment, health care,
12 housing, or transportation, an analysis of whether the bill is
13 likely to have a racially or ethnically disparate impact.
14 (e) (d) Any other information the house fiscal agency
15 considers necessary to explain the fiscal effect of the bill,
16 including, but not limited to, potential impacts to local units of
17 government.
18 (2) The house fiscal agency shall provide the fiscal analysis
19 prepared under subsection (1) to the clerk of the committee and to
20 the public on the internet.
21 (3) The house fiscal agency shall prepare a revised fiscal
22 analysis, as necessary, that incorporates any change to a bill
23 described in subsection (1).
24 (4) For the analysis required under subsection (1)(d), both of
25 the following apply:
26 (a) The house fiscal agency shall examine the likely effect
27 the bill would have on the distinct racial or ethnic groups listed
28 in the most recent federal decennial census.
29 (b) The analysis must include whether the bill is likely to

1 have a disproportionate or unique impact on any particular racial
2 or ethnic group and contain the rationale and statistics used to
3 reach any conclusion made in the analysis.
4 (5) The house fiscal agency may request information necessary
5 to conduct the analysis required under subsection (1)(d) from any
6 source. If the house fiscal agency requests information from a
7 state governmental officer or entity, that state governmental
8 officer or entity shall disclose the requested information to the
9 house fiscal agency if the disclosure is not otherwise in violation
10 of state law.
11 (6) Subject to appropriation, the house fiscal agency shall
12 acquire any additional expertise necessary to complete the analysis
13 required under subsection (1)(d).
