SUMMARY:
House Bill 5000 would amend 1935 PA 120, which regulates the fingerprinting of state
residents, by extending the sunsets on fees collected by the Department of State Police
(MSP) for collecting fingerprints and processing fingerprint and name-based criminal
record checks. Without an extension of the sunsets, fees would not be collected after
September 30, 2023. The bill would extend the sunsets date to October 1, 2027. FY 2022-
23 fee amounts would be maintained under the bill. Fees are currently set at $30 for taking
and processing fingerprints and completing a criminal record check and $10 for processing
a name-based criminal record check. Sunsets on both fees were previously extended in
2019.

FISCAL IMPACT:
The bill would maintain the current level of revenue collected by MSP, to the extent that
the department would continue collecting revenue generated by fees that would otherwise
sunset. Revenue generated from the fees is deposited to the Criminal Justice Information
Center (CJIC) Service Fees Fund and expended for taking and processing fingerprints,
completing criminal record checks, maintaining the Internet Criminal History Access Tool
(ICHAT), through which name-based criminal records checks are processed, and
supporting the administration of the CJIC. Based on information provided by the Michigan
State Police, the estimated revenue loss if the sunsets are not extended would total
approximately $23.0 million annually.
