A bill to amend 1993 PA 354, entitled
"Railroad code of 1993,"
(MCL 462.101 to 462.451) by adding section 352.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 352. (1) Except as provided in subsection (2), a railroad
2 shall not operate a train or locomotive engine engaged in
3 transporting freight unless the train or locomotive engine is
4 operated by a crew of not fewer than 2 individuals.
5 (2) Subsection (1) does not apply under either of the
6 following circumstances:

1 (a) Operating a locomotive engine in hostler service.
2 (b) Operating a locomotive engine in helper service.
3 (3) As used in this section:
4 (a) "Helper service" means assisting a train that is
5 experiencing a mechanical failure or that is ascending or
6 descending a grade by coupling a locomotive engine to the front or
7 rear of the train.
8 (b) "Hostler service" means moving a train or locomotive
9 engine a short distance within a railroad yard or mechanical
10 facility.
11 (c) "Train" means 1 or more locomotive engines, coupled with
12 or without cars, that are required to undergo air brake testing
13 under 49 CFR 232.
