A bill to amend 1994 PA 451, entitled
"Natural resources and environmental protection act,"
(MCL 324.101 to 324.90106) by adding section 8307g.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 8307g. (1) Beginning 1 year after the effective date of
2 the amendatory act that added this section, a person shall not use
3 a neonicotinoid pesticide on public land. This subsection does not
4 apply if both of the following occur:
5 (a) A valid environmental emergency exists.
6 (b) Any other pesticide that is not a neonicotinoid pesticide

1 would be less effective in addressing the environmental emergency.
2 (2) Within 1 year after the effective date of the amendatory
3 act that added this section, the department shall report to the
4 legislature on the latest published and peer-reviewed evidence on
5 whether the outdoor application of neonicotinoid pesticides is safe
6 for monarch butterflies, other pollinators, beneficial insects, the
7 environment, and public health.
8 (3) The governing body of a local unit of government may enact
9 an ordinance that regulates the use of neonicotinoid pesticides and
10 imposes stricter requirements than the prohibition described under
11 subsection (1).
12 (4) As used in this section:
13 (a) "Neonicotinoid pesticide" means a class of pesticides that
14 affects the central nervous system of an insect and includes any of
15 the following active ingredients:
16 (i) Acetamiprid.
17 (ii) Clothianidin.
18 (iii) Dinotefuran.
19 (iv) Imidacloprid.
20 (v) Thiacloprid.
21 (vi) Thiamethoxam.
22 (b) "Valid environmental emergency" means a sudden onset
23 disaster or accident that results from natural, technological, or
24 human-induced factors, or a combination of factors, and causes or
25 threatens to cause severe environmental damage and loss of human
26 lives and property.
