A bill to amend 1937 PA 329, entitled
"An act providing for compensation to certain peace officers
injured in active duty, and payment to surviving spouses and
dependents in case of death arising from active duty; and to make
an appropriation therefor,"
by amending section 2 (MCL 419.102), as amended by 1983 PA 210.
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 2. (1) The surviving spouse or dependents of a peace
2 officer of this state or of a political subdivision of this state
3 who is killed as the result of active duty in enforcing the laws of

1 this state or the laws of an adjoining state shall receive the sum
2 of $1,000.00 for defraying the expense of last sickness and burial
3 and $18.00 a week until a total sum of $5,000.00 is paid. As used
4 in this section: ,
5 (a) "surviving "Surviving spouse" means the spouse of the
6 peace officer, if living, and until remarriage.
7 (b) "dependent" "Dependent" means the children of the peace
8 officer, if dependent; the mother, father, or both, parent or
9 parents of the peace officer, if dependent; and the brothers and
10 sisters siblings of the peace officer, if dependent; in the order
11 named.
12 (2) If the peace officer does not leave a surviving spouse or
13 any dependents as defined in this section, the estate of the peace
14 officer shall receive the sum of $1,000.00 for the expense of the
15 peace officer's last sickness and burial.
16 Enacting section 1. This amendatory act does not take effect
17 unless Senate Joint Resolution ____ or House Joint Resolution F
18 (request no. 00367'23) of the 102nd Legislature becomes a part of
19 the state constitution of 1963 as provided in section 1 of article
20 XII of the state constitution of 1963.
