A bill to amend 2008 PA 537, entitled
"Michigan retired law enforcement officer's firearm carry act,"
by amending sections 7 and 12 (MCL 28.517 and 28.522).
THE PEOPLE OF THE STATE OF MICHIGAN ENACT:
1 Sec. 7. (1) The commission or its agent shall issue a
2 certificate to a qualified retired law enforcement officer who has
3 complied with the active duty firearms standard and is eligible to
4 carry a concealed firearm under 18 USC 926C and this act.
5 (2) A certificate holder shall carry the certificate and a
6 valid driver license or Michigan personal identification card on

1 his or her that person at all times while in possession of a
2 concealed firearm and shall produce the documents upon demand by a
3 peace officer.
4 (3) A certificate holder who is carrying a concealed firearm
5 and who is stopped by a peace officer shall immediately disclose to
6 the peace officer that he or she the individual is carrying a
7 concealed firearm on his or her person or is transporting a firearm
8 in his or her the individual's vehicle.
9 (4) Upon notice of revocation, a certificate holder is
10 required to forfeit his or her the individual's certificate to the
11 commission by returning the certificate in person to the commission
12 or returning the certificate by certified mail.
13 (5) A violation of this section subjects the certificate
14 holder to the penalties provided in section 5f of 1927 PA 372, MCL
15 28.425f, including forfeiture of the firearm.
16 Sec. 12. A firearm that is carried in violation of this act is
17 subject to seizure and forfeiture in the same manner that property
18 is subject to seizure and forfeiture under sections 4701 to 4709
19 chapter 47 of the revised judicature act of 1961, 1961 PA 236, MCL
20 600.4701 to 600.4709. This section does not apply if the violation
21 is a state civil infraction under section 5f of 1927 PA 372, MCL
22 28.425f, unless the individual fails to present his or her
23 certificate within the 45-day period described in that
24 section.600.4710.
25 Enacting section 1. This amendatory act does not take effect
26 unless Senate Bill No.____ or House Bill No. 4710 (request no.
27 03199'23) of the 102nd Legislature is enacted into law.
