SUMMARY:
House Bill 4696 is a companion bill to both Senate Bill 367, 1 which implements early voting
and allows absentee ballots to be tabulated before election day, and Senate Bill 370, 2 which
amends the Michigan Election Law to make several changes regarding absentee voting.
The bill adds the felony created by SB 367 to the sentencing guidelines provisions of the Code
of Criminal Procedure. Under the bill, disclosing an election result from an early voting site
before election day is a class E felony against the public trust with a statutory maximum term
of imprisonment of five years.
The bill also updates references to the Michigan Election Law to reflect paragraph numbering
changes, and the removal of a subsection, made by SB 367 and SB 370.

FISCAL IMPACT:
House Bill 4696 is a companion bill that amends the sentencing guidelines in the Code of
Criminal Procedure to reflect changes proposed by Senate Bills 367 and 370. The bill would
not have any fiscal impact on the state or local units of government.
