SUMMARY:
House Bill 4698 is a companion bill to Senate Bills 459, 460, and 461 that would exclude
mobile driver’s licenses and mobile state identification cards from the definition of
identification for election purposes under the Michigan Election Law.
Under the Michigan Election Law, a person must present identification for election
purposes to identify themselves when, among other things, voting in person or applying
in person for an absent voter ballot. Currently, the term means any of the following:
• A driver’s license or enhanced driver’s license issued by the state of Michigan.
• An official state personal identification card or enhanced official state personal
identification card issued by the state of Michigan.
• A current driver’s license issued by another state.
• A current state personal identification card issued by another state.
• A current state government issued photo identification card.
• A current United States passport or photo identification card issued by the
federal government.
• A current military photo identification card.
• A current tribal photo identification card.
• A current photo identification card issued by a local government.
• A current student photo identification card issued by an educational institution.
Under the bill, mobile driver’s licenses issued under the Motor Vehicle Code (as provided
for by SB 461), mobile enhanced driver’s licenses and official state personal identification
cards issued under the Enhanced Driver License and Enhanced Official State Personal
Identification Card Act (as provided for by SB 460), and mobile official state personal
identification cards issued under 1972 PA 222 (as provided for by SB 459) would not be
considered driver’s licenses or official state personal identification cards for election
identification purposes.
The bill is tie-barred to Senate Bills 459, 460, and 461, which means that it could not go
into effect unless they were also enacted.
