 An Act to Confirm and Finalize the Boundary Between the Town of Kittery
                          and the Town of York
    Emergency preamble. Whereas, acts and resolves of the Legislature do not
become effective until 90 days after adjournment unless enacted as emergencies; and
    Whereas, the communities of Kittery and York have experienced a history of border
disputes and disagreement over the municipal boundary line between the 2 towns; and
   Whereas, the 2 towns have reached a mutually agreed-upon description of their
common boundary in an amicable manner; and
     Whereas, it is in the public interest to immediately acknowledge the amicable
settlement of the boundary line dispute between the 2 towns as mutually agreed upon; and
    Whereas, in the judgment of the Legislature, these facts create an emergency within
the meaning of the Constitution of Maine and require the following legislation as
immediately necessary for the preservation of the public peace, health and safety; now,
therefore,
Be it enacted by the People of the State of Maine as follows:
    Sec. 1. Boundary line. Notwithstanding any provision of law to the contrary, the
boundary line between the Town of Kittery and the Town of York is as described:
     Beginning at the base of a 5-foot tall 3-inch by 9-inch granite monument found at the
northwesterly corner of the Town of Kittery and the southwesterly line of the Town of
York, located N 35°48'52" E, a distance of 48.45 feet from a 2-foot tall 6-inch by 6-inch
granite monument found with disc stamped "1995 YORK ELIOT STA 202-49.63 CIVIL
CONSULTANTS PLS 1302" at the northeasterly corner of the Town of Eliot and common
line of the Towns of York and Kittery;
    1. Thence S 74°55'57" E, a distance of 151.79 feet to the centerline of a discontinued
road known as Gee Road or Old Cutts Road;
    2. Thence S 58°04'52" E, a distance of 1,591.44 feet;

    3. Thence S 53°25'18" E, a distance of 2,048.07 feet to a 5/8-inch iron rebar with
