This bill authorizes the town of South Hadley to issue additional licenses for the sale of all alcoholic beverages, overriding section 17 of chapter 138 of the General Laws. Specifically, it allows for the granting of four additional licenses for on-premises consumption and two for off-premises consumption, contingent upon the approval of the town's licensing authority. These licenses are restricted to establishments located within designated economic development zones, which include the Route 202 & 33 district, Village Commons district, South Hadley Falls district, and Newton Street/Lyman Street district. Each license must be clearly marked with its applicable location and is subject to all provisions of chapter 138, except for section 17.
The bill also outlines specific conditions for the use and transfer of these licenses. For instance, on-premises licenses must be exercised in designated dining areas, and transfers outside the initial zoned areas are prohibited unless certain conditions are met. If a license is terminated or not renewed, it must be returned to the licensing authority, which can then grant it to a new applicant under the same conditions. All licenses must be issued within three years of the act's passage, with provisions for renewal to new applicants thereafter. The act will take effect immediately upon passage.
