The bill proposes an amendment to the home rule charter of the town of Falmouth, Massachusetts, to establish a new Falmouth Licensing Commission. This commission will consist of five members appointed for three-year terms and will serve as the licensing authority for various types of licenses, including those for innholders, common victuallers, and alcoholic beverages, as well as entertainment licenses. The commission will have the authority to create rules and regulations regarding these licenses, enforce relevant laws, and impose conditions and restrictions in the public interest.
To implement this change, the bill deletes section C3-7(B) from Article 3 of the charter and renumbers the remaining sections accordingly. Additionally, it inserts a new section C7-9 into Article 7, detailing the powers and responsibilities of the Licensing Commission. The Select Board is also granted the authority to assign additional licensing powers to the commission through a general bylaw. The act is set to take effect on January 1, 2027, and requires the Select Board to appoint the initial members of the commission within 30 days of the bill's passage.
