This bill authorizes the Division of Capital Asset Management and Maintenance to release a portion of a sewer line easement located in the West Roxbury section of Boston for the benefit of Nora, LLC, the owner of the property at 49 Charles Park Road. The easement, originally established for sewer-related purposes in 1897, will be released under specific terms and conditions set by the commissioner of capital asset management and maintenance, in consultation with the Massachusetts Water Resources Authority. The exact boundaries of the easement to be released will be determined based on a survey.
Additionally, the bill stipulates that the consideration for this release will be based on the full and fair market value of the easement, as assessed by an independent professional appraisal. The appraisal will be reviewed by the inspector general, who will prepare a report for the commissioner. Before any documents are executed to finalize the release, the commissioner must submit the appraisal and the inspector general's report to the relevant legislative committees. Nora, LLC will also be responsible for all associated costs, including surveys and recording fees related to the easement release.
