The proposed bill aims to prohibit the harvesting of horseshoe crabs, specifically the species Limulus polyphemus, for bait. It mandates the Department to create a plan that will phase out the taking of horseshoe crabs, achieving complete cessation by January 1, 2029. The bill allows for exceptions where the director can issue permits for educational or scientific purposes, provided that such activities do not harm the horseshoe crab population. Additionally, incidental taking of horseshoe crabs during legal fishing operations is permitted as long as the crabs are returned unharmed to coastal waters.
Violations of this new regulation will result in a fine of $25 for each horseshoe crab taken from coastal waters, although possessing a cast-off or molted shell (exoskeleton) will not incur penalties. The bill also empowers the division to establish rules and regulations to ensure compliance with these provisions.
