The bill amends Chapter 270 of the General Laws by introducing a new section that regulates the sale and distribution of kratom products. It defines key terms such as "kratom product," "kratom retailer," and "manufacture," and establishes labeling requirements for kratom products, which must include the manufacturer's name and address, a complete list of ingredients, and usage directions. The bill prohibits kratom retailers from selling adulterated or contaminated products, those containing excessive levels of 7-hydroxymitragynine, or any synthetic alkaloids. Additionally, it restricts sales to individuals under 21 years of age.
Violations of these regulations can result in administrative fines, with specific penalties outlined for different offenses. A retailer may be fined up to $500 for initial violations of labeling or safety standards, and up to $1,000 for subsequent violations. For selling to minors, fines escalate from $1,000 for the first offense to $5,000 for third or subsequent offenses. The Department of Public Health is tasked with creating rules for enforcement and safety testing of kratom products. The act will take effect 180 days after its passage.
