The proposed bill aims to strengthen penalties for non-consensual image sharing and enhance support services for victims. It mandates that any individual suspected or convicted of criminal harassment related to the non-consensual distribution of explicit images will have their electronic devices confiscated by law enforcement for use as evidence in prosecution. Additionally, the bill amends existing legal language to clarify that individuals who knowingly possess illegally distributed explicit material, along with those who violate a person's reasonable expectation of privacy regarding such material, can be charged with criminal harassment, facing penalties of up to 2.5 years in a house of correction and/or fines up to $10,000.

Furthermore, the bill establishes a program led by the Attorney General in collaboration with the Massachusetts Office for Victim Assistance to provide comprehensive resources for victims of criminal harassment due to non-consensual image sharing. This program will offer various support services, including legal assistance, emotional and psychological support, and referrals to nonprofit organizations and advocacy groups, ensuring that victims receive the necessary help and resources to navigate their situations.
