The proposed bill aims to reform marijuana policy in Massachusetts by modifying the legal framework surrounding its possession, distribution, and use. It allows individuals aged 21 and over to possess up to 1 ounce of marijuana without facing civil or criminal penalties, while possession of between 1 and 2 ounces will incur a civil penalty of $100. Additionally, the bill repeals existing laws governing the retail sale of adult recreational marijuana, specifically Chapters 94G and 64N, and establishes that individuals can gift or transfer up to 1 ounce of marijuana to other adults without remuneration. For those under 21, possession of up to 2 ounces will also be treated as a civil infraction, subject to penalties including fines, forfeiture, and mandatory completion of a drug awareness program.
The bill retains the Cannabis Control Commission but limits its authority to regulating the medical marijuana market, allowing current recreational marijuana businesses to transition to medical dispensaries and sell their remaining inventory. The legislation emphasizes that if any part of the law is deemed invalid, the remaining provisions will still be enforceable. The effective date for this law is set for January 1, 2028.
