The proposed bill establishes a new chapter, Chapter 93M, in the General Laws concerning the repair of portable wireless devices. It defines key terms such as "authorized repair provider," "independent repair provider," "manufacturer," and "owner," and mandates that manufacturers must provide documentation, parts, and tools to both owners and independent repair providers on fair and reasonable terms. The bill also stipulates that manufacturers cannot require authorized repair providers to purchase diagnostic information in a proprietary format if it is available in a standardized format. Additionally, it clarifies that manufacturers are not obligated to disclose trade secrets and outlines the liability protections for manufacturers and authorized repair providers regarding repairs conducted by independent providers.

Furthermore, the bill requires independent repair providers to inform customers that they are not authorized repair providers and to disclose specific information about the repair process, including parts used and costs. The Attorney General is granted the authority to enforce the provisions of this chapter, including seeking injunctions against violations, with a 30-day notice period for businesses to rectify any alleged infractions. The act is set to take effect on January 1, 2027.
