It defines "licensee" to include any marijuana establishment licensed under this chapter and outlines that it is unlawful for any licensee to extend or receive credit for marijuana products sold to another licensee, except in the usual course of business and for a maximum of 60 days. If a licensee fails to pay within this period, they will be considered delinquent, and the licensee that extended credit must notify the Massachusetts cannabis control commission and the delinquent licensee. The commission will then maintain a delinquent list, which will be publicly accessible, and no licensee may transact with those on this list without full payment.
Additionally, the bill allows licensees who experience significant business disruptions due to unforeseen events to apply for a suspension of the delinquency provisions. The commission is tasked with reviewing these applications and may grant relief if deemed in the public interest. The bill also stipulates that no changes in ownership or control of a delinquent licensee can occur until all debts are settled, and it imposes a fine of up to $5,000 for violations of these provisions. The Massachusetts cannabis control commission is required to update regulations to align with this act within one year of its effective date.
