This bill authorizes the commissioner of capital asset management and maintenance to grant both permanent and temporary easements to the town of Bourne for lands used for armory purposes located on Armory Road. The easements are specifically intended for the installation, use, maintenance, repair, and replacement of a subsurface waterline. The bill establishes that the town of Bourne will bear all costs related to the engineering, surveys, appraisals, and other expenses necessary for executing the conveyances. Additionally, the easements will be granted under specific terms and conditions determined by the commissioner, in consultation with the adjutant general.
The bill also outlines the process for determining the consideration for the easements, which will be based on the greater of the full and fair market value or the value in proposed use, as assessed by an independent appraiser. The appraisal must be reviewed and approved by the inspector general, who will report on the methodology used. Furthermore, any instrument executed under this act must include a reversionary clause, ensuring that the easements are used solely for the specified purposes, with provisions for the town to remedy any violations before reversion to the commonwealth.
