This bill authorizes the town of Somerset to issue an additional license for the sale of wine and malt beverages for off-premises consumption, specifically to Olde Village Convenience Store located at 2756 County Street. This new license will be granted notwithstanding section 17 of chapter 138 of the General Laws, meaning that the usual restrictions of that section do not apply. The license will still be subject to all other provisions of chapter 138, and it cannot be transferred to another location. However, it can be granted to a new applicant at the same location if they provide proof of good standing with the department of revenue and the department of unemployment assistance.
Additionally, if the license is terminated, not renewed, or otherwise becomes inactive, it must be returned to the licensing authority, which can then reissue it to a new applicant at the same location within three years. The bill stipulates that the license must be issued within one year of the act's passage, and if granted within that timeframe, it can be transferred to a new applicant under the specified conditions thereafter. The act will take effect immediately upon its passage.
