The proposed bill, titled "An Act to Protect Avian Rights and Restrict Ongoing Trade," seeks to amend Chapter 140 of the General Laws in Massachusetts by introducing a new section, 141E, which specifically addresses the sale and transfer of parrots. Under this new provision, it will be illegal for any person to sell, offer for sale, exchange, trade, barter, lease, or transfer a parrot for permanent physical placement. However, individuals will be allowed to surrender parrots to registered animal rescue organizations or public animal control facilities without compensation. These organizations may then transfer the parrots to individuals for permanent placement without any financial exchange.
The bill also establishes penalties for violations, imposing fines of up to $1,000 for each offense, with each illegal transaction considered a separate violation. Enforcement of this section will be the responsibility of local animal control officers or police, following the guidelines set forth in section 21D of chapter 40. The act is set to take effect 180 days after its passage.
